Agee, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Washington County, Case No. CRF-75-386, of the crime of Burglary in the Second Degree, in violation of 21 O.S. 1971 ? 1435 [21-1435]. Punishment was assessed at a term of four (4) years in the custody and control of the Department of Corrections of the State of Oklahoma. From said judgment and sentence the defendant has perfected this timely appeal.
